ActiKidz terms of service

These Terms of Service ("Terms") govern your use of the ActiKidz platform, including the family portal, provider/merchant portal, public discovery pages, and ActiKidz-supplied APIs. By creating an account or using the service you agree to these Terms. The current, regularly versioned Terms text loads from our content management system when you reach this page in a browser.

1. Who can use ActiKidz

The service is available to (a) parents and legal guardians creating accounts on behalf of their children, (b) adult students with their parent or guardian's agreement, (c) teachers and private coaches operating lawfully in their region, and (d) registered education businesses (studios, schools, training centers) including their staff. You must be at least the age of majority in your province to operate a provider account.

2. Account responsibilities

You agree to provide accurate information, keep your password and authentication factors confidential, and notify us promptly if you suspect unauthorized access. Provider accounts are responsible for actions taken by sub-users they invite (teachers, branch managers). You are responsible for the legality of content and information you upload, including student records and marketing copy.

3. Service description

ActiKidz provides scheduling, enrollment, attendance, class reports, payment processing (via Stripe), notifications, AI assistants for class summaries and management, and family-facing tools such as growth tracking. Specific features available to your plan are described on the pricing page and may evolve over time.

4. Payments, refunds, and taxes

Provider subscriptions and family transactions are processed via Stripe. ActiKidz collects and remits sales tax (GST/HST/PST) where required by Canadian law. Refunds for provider subscription plans are governed by the plan terms shown at checkout. Refunds for family-to-provider transactions are governed by the individual provider's published refund policy.

5. Acceptable use

You agree not to: misuse student or family data, scrape the platform at scale, attempt to bypass authentication or rate limits, upload malware or unlawful content, impersonate others, or use the service to harass any user. We reserve the right to suspend accounts violating these rules with reasonable notice except in security emergencies.

6. Intellectual property

ActiKidz owns the platform, branding, and aggregated platform statistics. You retain ownership of content you upload (lesson plans, marketing copy, student records). You grant ActiKidz a non-exclusive license to host and process your content as needed to deliver the service.

7. Privacy

Our Privacy Policy describes how we handle personal information. By using the service you agree to that policy.

8. Disclaimers and limitation of liability

The service is provided on an "as available" basis. To the maximum extent permitted by law, ActiKidz disclaims implied warranties not expressly granted here. ActiKidz is not liable for indirect, incidental, or consequential damages. Aggregate liability for direct damages is limited to fees paid in the 12 months prior to the claim.

9. Termination

You may close your account at any time through account settings. We may suspend or terminate accounts for material breach of these Terms, non-payment, or as required by law. Upon termination we retain financial records as required by tax law; other personal data is handled per the Privacy Policy and our deletion workflow.

10. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Disputes will be resolved in the courts of British Columbia, except where applicable consumer protection law gives you a non-waivable right to a different forum.

11. Changes

We may update these Terms. Material changes are notified by in-app banner and email at least 14 days before they take effect; continued use after that constitutes acceptance.
